Building Code

OVERVIEW
 
 On July 27, 2025, the State Fire Prevention and Building Code Council (the “Code Council”) adopted rules that amended and updated the New York State Uniform Fire Prevention and Building Code (the “Uniform Code”) and the State Energy Conservation Construction Code (the “Energy Code”). 
 
The Department of State, acting on behalf of the Code Council, filed Notices of Adoption of these rules. The Notices of Adoption appears in the October 1, 2025 edition of the State Register. On and after October 1, 2025, the October 1, 2025 edition of the State Register can be viewed by clicking the "October 1" link at https://dos.ny.gov/state-register.
 
 The rules will become effective on December 31, 2025.
 
Uniform Code
 The rule adopted by the Code Council on July 25, 2025 repealed the 2020 edition of the Uniform Code and adopted an amended and updated edition of the Uniform Code.  The amended and updated edition of the Uniform Code incorporated, by reference, the following publications:
  • 2025 Residential Code of New York State (publication date: July 2025)
  • 2025 Building Code of New York State (publication date: July 2025)
  • 2025 Plumbing Code of New York State (publication date: July 2025)
  • 2025 Mechanical Code of New York State (publication date: July 2025)
  • 2025 Fuel Gas Code of New York State (publication date: July 2025)
  • 2025 Fire Code of New York State (publication date: July 2025)
  • 2025 Property Maintenance Code of New York State (publication date: July 2025)
  • 2025 Existing Building Code of New York State (publication date: July 2025)

 Effective Date:  The effective date of the 2025 NYS Uniform Code is December 31, 2025. In addition, the Code Council voted to provide that, during the transition period between the publication of the Notice of Adoption and the effective date of the 2025 NYS Uniform Code, a person shall have the option of complying with either the provisions of the 2025 Uniform Code or the 2020 Uniform Code.
Beginning on December 31, 2025, regulated parties submitting building permit applications are required to comply with the 2025 NYS Uniform Code.
 
Energy Code
 
 The rule adopted by the Code Council on July 27, 2025 repealed the 2020 edition of the Energy Code and adopted an amended and updated edition of the Energy Code.  The amended and updated edition of the Energy Code incorporated, by reference, the following publications:
  • 2025 Energy Conservation Construction Code of New York State (publication date: July 2025)
  • NYS ASHRAE 90.1-2025 – NYS version of the Energy Standard for Buildings Except Low-Rise Residential Buildings ("NYS ASHRAE 90.1-2025")​

Effective Date:  The effective date of the modifications to Part 1240 is December 31, 2025.  There is no transition period.  Beginning on December 31, 2025, regulated parties submitting building permit applications will be required to comply with the 2025 ECCCNYS and NYS ASHRAE 90.1-2025.

New York State Uniform Code (effective December 31st, 2025)
  • The Building Code of New York State (BCNYS) applies to all new building construction not within the scope of the RCNYS and the actual repair work plus additions on buildings.
  • The Existing Building Code of New York State (EBCNYS) applies to repair, alteration, change of occupancy, addition to and relocation of existing buildings. This code regulates buildings that often would not comply with the current building code requirements for new construction and doing so would be cost-prohibitive, but these buildings are nevertheless salvageable if basic levels of safety features are maintained.
  • The Property Maintenance Code of New York State (PMCNYS) regulates the minimum maintenance requirements of existing buildings, including all residential and nonresidential structures and all existing premises.
  • The Residential Code of New York State (RCNYS) is a comprehensive, stand-alone code regulating the construction and repair of single-family houses, two-family houses (duplexes) and townhouses with three or more units, all no more than three stories.
  • Other Codes: The New York State Fire, Fuel Gas, Mechanical and Plumbing Codes included in the Uniform Code regulate their subjects. Electrical work is regulated by Chapter 27 of the BCNYS and the 2023 NEC.
